Introduction

These Terms and Conditions (“Terms”) govern the use of OZZIA’s services, including sailing

experiences, events, and the provision of food and drinks (“Services”). By booking or attending our

Services, you (“Customer”, “you”, “your”) agree to these Terms.

1. Bookings, Payments & Billing

1.1 All bookings must be made through our official website, booking partners, or authorised

representatives.

1.2 Full payment is required at the time of booking unless otherwise agreed in writing.

1.3 Prices are stated in Australian Dollars (AUD) and include GST, unless stated otherwise.

1.4 OZZIA reserves the right to change prices at any time, but confirmed bookings will not be

affected.

1.5 You are responsible for providing accurate payment details. Any failed or reversed transactions

may result in cancellation of your booking.

2. Refunds & Cancellations

2.1 Customer Cancellations:

- Cancellations made 7 days or more before the scheduled Service are eligible for a full refund.

- Cancellations made less than 7 days but more than 48 hours before the Service may be eligible

for a partial refund or credit, at OZZIA’s discretion.

- Cancellations within 48 hours of the Service are non-refundable.

2.2 Company Cancellations:

- OZZIA reserves the right to cancel or reschedule Services due to weather conditions, safety

concerns, mechanical issues, or unforeseen circumstances.

- In such cases, customers will be offered a refund or a credit toward a future booking.

2.3 Refunds will be processed back to the original payment method within a reasonable timeframe,

subject to banking delays.

3. Safety & Conduct

3.1 Customers must comply with all safety instructions given by OZZIA staff and crew.

3.2 OZZIA reserves the right to refuse service to any person who is intoxicated, behaving

recklessly, or poses a safety risk.

3.3 Customers must be of legal drinking age (18+) to consume alcohol on board. Proof of age may

be required.

4. Liability & Disclaimer

4.1 Participation in sailing and related activities involves inherent risks. Customers accept

responsibility for their own safety and belongings.

4.2 To the extent permitted by law, OZZIA shall not be liable for any loss, injury, or damages arising

from participation in the Services.

4.3 Nothing in these Terms excludes any rights under the Australian Consumer Law (ACL) that

cannot be waived.

5. Intellectual Property

5.1 All content, branding, and materials provided by OZZIA remain our intellectual property.

5.2 Customers may not reproduce, distribute, or use our intellectual property without prior written

consent.

6. Governing Law & Dispute Resolution

6.1 These Terms are governed by the laws of New South Wales, Australia.

6.2 In the event of a dispute, both parties agree to first attempt resolution through good-faith

negotiation.

6.3 If a resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the

courts of New South Wales, Australia.

7. Amendments

7.1 OZZIA may update these Terms at any time. Changes will be posted on our website with the

“Effective Date” updated accordingly.

7.2 Continued use of our Services after changes are published constitutes acceptance of the

revised Terms.
